Turkiye E-SIM Terms of Use (EULA)

These Terms of Use ("Terms", "Agreement", or "EULA") constitute a legally binding agreement between you ("User", "you", or "your") and Turkiye E-SIM ("Company", "we", "us", or "our") governing your access to and use of the Turkiye E-SIM mobile application, website, and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Definitions

• Application: The Turkiye E-SIM mobile application available on supported platforms.
• eSIM Profile: A digital SIM profile delivered electronically for installation on a compatible device.
• Data Package: A prepaid mobile data plan or related connectivity offering made available through the Service.
• Subscription: An auto-renewing paid plan, where applicable, billed on a recurring basis through the applicable app store.
• Device: Any smartphone, tablet, or other hardware used to access or install the Service or an eSIM Profile.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application for your personal, non-commercial use on devices you own or control.

Except for the limited license expressly granted above, no rights are granted to you under any intellectual property of the Company or its licensors. All rights not expressly granted are reserved.

3. Eligibility and Account Responsibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. If you are under the age of majority, you may use the Service only with the consent of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information and to keep it up to date.

4. Service Description

Turkiye E-SIM provides digital connectivity services, including the sale and delivery of eSIM Profiles and Data Packages for use in supported countries and regions. Availability, coverage, speed, and network quality depend on third-party mobile network operators and are not guaranteed by us.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, where permitted by law.

5. Device Compatibility and User Setup

You acknowledge and agree that successful use of an eSIM Profile depends entirely on factors outside our control, including but not limited to:

• Whether your Device is eSIM-compatible, carrier-unlocked, and permitted to install eSIM Profiles in your country or region;
• Your Device model, operating system version, firmware, and manufacturer restrictions;
• Whether your Device is subject to carrier lock, enterprise management (MDM), regional restrictions, or software modifications (including jailbreaking or rooting);
• Your ability to correctly follow installation, activation, APN, roaming, and network selection instructions;
• Local network conditions, operator policies, roaming agreements, congestion, outages, maintenance, or regulatory restrictions;
• Conflicts with existing physical SIMs, dual-SIM configurations, or other installed eSIM Profiles;
• Incorrect deletion, reinstallation, transfer, or modification of an eSIM Profile after delivery.

It is your sole responsibility to verify Device compatibility before purchase and to correctly install, activate, configure, and use the eSIM Profile. We strongly recommend reviewing compatibility requirements and setup instructions before completing any purchase.

We do not guarantee that any eSIM Profile will function on your Device or in your location. Failure of an eSIM Profile to install, activate, connect, or deliver expected data speeds does not, by itself, indicate a defect in the Service where such failure results from Device limitations, user configuration errors, network operator issues, or other factors listed above.

6. Purchases, Pricing, and Delivery

Prices, data allowances, validity periods, and package features are displayed before purchase and may change at any time for future purchases. Once a Data Package or eSIM Profile is delivered or activated, except where required by applicable law or the relevant app store policy, purchases are generally final and non-refundable.

Delivery of eSIM Profiles is electronic. You are responsible for ensuring that your Device remains connected to the internet during installation and that you do not share, expose, or misuse QR codes, activation codes, or profile credentials.

Data consumption rates vary based on usage, content type, background processes, and Device settings. Time-limited packages may expire before the stated duration if included data is fully consumed.

7. Auto-Renewable Subscriptions

If you purchase an auto-renewable Subscription through the Apple App Store or another supported platform, the following terms apply in addition to these Terms and the applicable store's terms:

• Payment: Payment will be charged to your app store account at confirmation of purchase.
• Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Billing: Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown at the time of purchase, unless otherwise notified.
• Management: You may manage or cancel Subscriptions in your device account settings. For Apple devices: Settings → [Your Name] → Subscriptions.
• Free trials: If offered, any unused portion of a free trial period will be forfeited when you purchase a Subscription, where applicable.

Subscription titles, durations, and prices are displayed in the applicable purchase flow before you confirm payment. Refund requests for Subscriptions purchased through the Apple App Store must be submitted to Apple in accordance with Apple's policies.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or unauthorized purpose;
• Resell, redistribute, sublicense, or commercially exploit eSIM Profiles or Data Packages without our written consent;
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from the Application;
• Interfere with or disrupt the Service, networks, or security-related features;
• Use the Service in a manner that violates applicable telecommunications, export control, or sanctions laws;
• Misrepresent Device compatibility, usage location, or identity to obtain Service benefits.

9. Third-Party Services and Networks

The Service relies on third-party mobile network operators, payment processors, app stores, and infrastructure providers. We do not control and are not responsible for the acts, omissions, outages, policies, or performance of any third party.

Your use of the Apple App Store, Google Play, or other distribution platforms is governed by their respective terms and policies.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service, including all eSIM Profiles, Data Packages, connectivity, and related content, is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

Without limiting the foregoing, we expressly disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted or error-free operation, and any warranty arising from course of dealing or usage of trade.

We do not warrant that any eSIM Profile will install successfully, remain active, provide coverage in any specific location, achieve any particular speed or latency, or function with your Device. You assume all risk associated with Device compatibility, installation, configuration, and use.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company, its affiliates, directors, officers, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, data, goodwill, business interruption, travel costs, replacement device costs, or other intangible losses, arising out of or related to your use of or inability to use the Service.

To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid to us for the specific Data Package, eSIM Profile, or Subscription giving rise to the claim during the twelve (12) months preceding the event, or (b) fifty United States dollars (USD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any dispute relating to Device compatibility, installation, or configuration attributable to your actions or omissions.

13. Support and Dispute Resolution

If you experience issues with the Service, you must contact our support team promptly and provide relevant details, including Device model, operating system version, purchase information, error messages, and steps already taken. We may provide reasonable assistance, but support does not constitute a warranty and does not expand our liability beyond what is stated in these Terms.

Before initiating formal proceedings, you agree to contact us at info@turkiyesim.com and attempt to resolve the matter in good faith.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required for legal, security, or operational reasons.

Upon termination, your license to use the Application ends immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, limitation of liability, and indemnification.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal data.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated through the Application or by other reasonable means. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the Republic of Türkiye, without regard to conflict of law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.

18. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any purchase terms presented at checkout, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous understandings on the subject matter.
